Mediation – Smart, Cost-Effective Alternative to Litigation
Why Family Mediation is a Smart, Cost-Effective Alternative to Litigation
Family disputes—whether related to parenting, separation, support, or property—can quickly become emotionally and financially draining when handled through the courts. Fortunately, mediation offers a more affordable, efficient, and respectful path forward.
At Stewart Legal & Mediation, we specialize in family mediation that focuses on the benefits of mediation over litigation and prioritizes collaboration, clarity, and long-term solutions—without the time and cost of drawn-out litigation.
What Is Family Mediation?
Family mediation is a voluntary process in which a neutral third party (the mediator) helps families work through disagreements and reach mutually acceptable solutions. Whether you’re navigating separation, parenting plans, or financial arrangements, mediation can help reduce conflict and promote healthier communication.
A Cost-Effective Solution
Litigation can cost thousands in legal fees, take months (or even years), and often increases conflict between parties. Mediation is a fraction of the cost and typically requires fewer sessions. With our flat-rate or hourly fee options, you remain in control of your budget—and your outcome.
Our Role: Providing Legal Information, Not Legal Advice
As mediators, we offer legal information to help both parties understand the relevant laws and how they apply to your situation. However, we do not provide legal advice to either party. To ensure fairness and that your rights are protected, it is always advisable for each party to obtain independent legal advice (ILA) during the mediation process.
Why Independent Legal Advice Matters
Even if you reach an agreement in mediation, a judge may want to know that:
- Both parties have had an opportunity to speak to their own lawyer;
- You fully understand the pros and cons of what you’re agreeing to;
- There were no unfair practices, coercion, or imbalances of power;
- The terms are informed and reasonable for both sides.
Â
Independent legal advice gives you that assurance—and helps avoid potential issues if a court is later asked to make the agreement into a binding order.
Finalizing Your Agreement
When an agreement is reached, we prepare a Mediation Report that outlines the terms discussed and agreed upon. This document can be taken to your respective lawyers for review. If needed, and if both parties agree, it can also be submitted to the court to form the basis of a consent order or a final court order.
The Bottom Line
Family mediation helps you:
- Save money and time
- Keep control of the outcome
- Reduce conflict and preserve relationships
- Prepare fair and informed agreements
- Access a court-ready Mediation Report if needed
